{"id":3920,"date":"2025-01-22T20:38:30","date_gmt":"2025-01-22T19:38:30","guid":{"rendered":"https:\/\/www.gfima.es\/?p=3920"},"modified":"2025-02-21T12:46:51","modified_gmt":"2025-02-21T11:46:51","slug":"contrato-compraventa","status":"publish","type":"post","link":"https:\/\/www.gfima.es\/?p=3920","title":{"rendered":"Contratos de compraventa"},"content":{"rendered":"\n<ul class=\"wp-block-list\">\n<li>Contrato de compraventa de vivienda.<\/li>\n\n\n\n<li>Contrato de arras penitenciales.<\/li>\n\n\n\n<li>Contrato de arras penales.<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\">1. <strong>Contrato de compraventa de vivienda<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Definici\u00f3n:<\/strong> Es un acuerdo definitivo entre comprador y vendedor para transferir la propiedad de un inmueble a cambio de un precio pactado.<\/li>\n\n\n\n<li><strong>Caracter\u00edsticas principales:<\/strong>\n<ul class=\"wp-block-list\">\n<li>Obliga a ambas partes al cumplimiento del contrato.<\/li>\n\n\n\n<li>Transfiere la propiedad al comprador tras la firma de la escritura p\u00fablica y el pago total.<\/li>\n\n\n\n<li>Incluye detalles como la descripci\u00f3n de la vivienda, precio, estado de cargas, plazo de entrega y otras condiciones pactadas.<\/li>\n\n\n\n<li>No permite desistir del contrato sin consecuencias legales importantes.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\">2. <strong>Contrato de arras penitenciales<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Definici\u00f3n:<\/strong> Es un acuerdo preliminar en el que se entrega una cantidad de dinero (arras) como garant\u00eda del compromiso de compra o venta, pero con la posibilidad de desistir por parte de cualquiera de las partes.<\/li>\n\n\n\n<li><strong>Caracter\u00edsticas principales:<\/strong>\n<ul class=\"wp-block-list\">\n<li>Permite desistir del acuerdo de forma libre, pero con consecuencias econ\u00f3micas:\n<ul class=\"wp-block-list\">\n<li>Si el comprador desiste, pierde las arras.<\/li>\n\n\n\n<li>Si el vendedor desiste, debe devolver las arras duplicadas.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>No transfiere la propiedad, solo establece una reserva o compromiso inicial.<\/li>\n\n\n\n<li>Es m\u00e1s flexible, ya que no obliga al cumplimiento forzoso.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\">3. <strong>Contrato de arras penales<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Definici\u00f3n:<\/strong> Es un acuerdo preliminar en el que tambi\u00e9n se entrega una cantidad de dinero como garant\u00eda, pero con la particularidad de que no permite desistir libremente;
