El alto tribunal ha unificado criterios sobre el t\u00e9rmino \u201climitar\u201d, contenido en el art\u00edculo 17 de la Ley de Propiedad Horizontal (LPH). Aunque las modificaciones estatutarias en estas comunidades requieren unanimidad, desde la aprobaci\u00f3n del Real Decreto-Ley 7\/2019 se permite que las restricciones sobre viviendas tur\u00edsticas se aprueben con una mayor\u00eda cualificada de 3\/5.<\/p>\n\n\n\n<p>Juan Ram\u00f3n M\u00e9ndez, abogado especializado en alquiler vacacional, se\u00f1ala que esta normativa ha generado diferentes interpretaciones judiciales: algunos tribunales consideraban que \u00ablimitar\u00bb implicaba la posibilidad de prohibir por completo esta actividad, mientras que otros estimaban que tal prohibici\u00f3n exced\u00eda el alcance legal. \u00abEl Tribunal Supremo ha respaldado la primera postura, permitiendo a las comunidades de propietarios prohibir completamente el alquiler tur\u00edstico\u00bb, a\u00f1ade.<\/p>\n\n\n\n<p>Las sentencias recurridas por la Audiencia Provincial de Madrid y la de M\u00e1laga, ambas del 3 de octubre, reflejaban posturas opuestas sobre si la prohibici\u00f3n de actividades tur\u00edsticas bajo el art\u00edculo 5.e) de la Ley de Arrendamientos Urbanos (LAU) deb\u00eda adoptarse por mayor\u00eda de tres quintos o unanimidad. Con estas resoluciones, el Supremo ha zanjado la controversia, determinando que es suficiente la mayor\u00eda de 3\/5 para tales restricciones.<\/p>\n\n\n\n<p><strong>Retroactividad de la prohibici\u00f3n del alquiler vacacional<\/strong><\/p>\n\n\n\n<p>La norma establece que estos acuerdos no tendr\u00e1n efectos retroactivos, es decir, no afectar\u00e1n a quienes ya realizaban la actividad legalmente antes de la adopci\u00f3n del acuerdo. Desde el Colegio Profesional de Administradores de Fincas de Madrid (CAFMadrid) se recalca que solo ser\u00e1n vinculantes para los propietarios que, tras el acuerdo, deseen destinar sus viviendas al alquiler tur\u00edstico.<\/p>\n\n\n\n<p>CAFMadrid celebra las sentencias del Tribunal Supremo, pues considera que los pisos tur\u00edsticos generan problemas de convivencia en las comunidades, como ruidos, basura o inseguridad. La presidenta del CAFMadrid, Manuela J. Mart\u00ednez, destaca que la vida en comunidad no est\u00e1 dise\u00f1ada para actividades tur\u00edsticas, y que las sentencias proporcionan mayor seguridad jur\u00eddica tanto a las comunidades como a los administradores de fincas a la hora de tomar decisiones.<\/p>\n\n\n\n<p><strong>Implicaciones legales para las comunidades de propietarios<\/strong><\/p>\n\n\n\n<p>Seg\u00fan M\u00e9ndez, el acuerdo que limite o proh\u00edba el alquiler tur\u00edstico convierte esta actividad en contraria a los estatutos, lo que faculta a la comunidad para actuar legalmente contra quienes incumplan. Una vez aprobado el acuerdo, debe inscribirse en el Registro de la Propiedad, de modo que los futuros compradores conozcan la restricci\u00f3n.<\/p>\n\n\n\n<p>Adem\u00e1s, independientemente de la limitaci\u00f3n comunitaria, los propietarios que deseen destinar sus viviendas a alquiler tur\u00edstico deber\u00e1n contar con las autorizaciones administrativas locales o auton\u00f3micas pertinentes.<\/p>\n\n\n\n<p><strong>Consecuencias de incumplir la prohibici\u00f3n<\/strong><\/p>\n\n\n\n<p>Si se infringe la prohibici\u00f3n, la comunidad puede iniciar una acci\u00f3n de cesaci\u00f3n en virtud del art\u00edculo 7.2 de la LPH. Esto podr\u00eda llevar a la prohibici\u00f3n judicial de la actividad, indemnizaciones por da\u00f1os y perjuicios, e incluso la prohibici\u00f3n del uso de la vivienda hasta por tres a\u00f1os. Si el infractor es un inquilino, tambi\u00e9n podr\u00eda solicitarse la resoluci\u00f3n del contrato de arrendamiento y su desalojo.<\/p>\n\n\n\n<p><strong>Excepciones para el alquiler tur\u00edstico<\/strong><\/p>\n\n\n\n<p>La prohibici\u00f3n acordada por la comunidad de propietarios se limita al alquiler tur\u00edstico tal como lo define el art\u00edculo 5.e) de la Ley de Arrendamientos Urbanos.
